Terms And Conditions Of Hire

1. Introduction

These Terms and Conditions (‘Terms’) govern all hire agreements entered into between PA Systems Hire (‘the Company’, ‘we’, ‘us’, ‘our’) and the customer (‘the Hirer’, ‘you’, ‘your’) for the hire of audio equipment, public address systems, and related services.

By placing a booking with PA Systems Hire, whether verbally, in writing, by email, or via our website at www.pasystemshire.co.uk, you agree to be bound by these Terms and Conditions in their entirety. Please read them carefully before confirming your hire.

PA Systems Hire is a trading name of the Company, registered and operating from 29 Boston Road, Hanwell, London.

2. Definitions

In these Terms and Conditions, the following definitions apply:

  • Equipment” means all PA systems, speakers, amplifiers, mixing consoles, microphones, cabling, stands, and any other items supplied by the Company under the hire agreement.
  • Hire Period” means the agreed duration during which the Equipment is in the possession of the Hirer, from the point of delivery or collection to the point of return.
  • Hire Charges” means the fees payable by the Hirer for the use of the Equipment and any associated services.
  • Event Date” means the confirmed date(s) on which the Equipment is required for use.
  • Managed Hire” means a hire package that includes a PA Systems Hire engineer to set up, operate, and dismantle the Equipment at the event.
  • Dry Hire” means a hire package where the Equipment is supplied without an engineer, and the Hirer is responsible for set-up, operation, and dismantling.

3. Bookings and Confirmation

3.1 How to Book

Bookings can be made by contacting PA Systems Hire by telephone on 0203 4322 158, by email at sales@pasystemshire.co.uk, or through our website at www.pasystemshire.co.uk. All bookings are subject to equipment availability.

3.2 Booking Confirmation

A booking is only confirmed upon receipt of a signed hire agreement (where applicable) and the required deposit payment. PA Systems Hire reserves the right to treat any unconfirmed booking as provisional and to allocate equipment to other customers.

3.3 Accuracy of Information

It is the Hirer’s responsibility to ensure that all information provided at the time of booking is accurate, including the event date, venue address, type of event, expected number of attendees, and any specific technical requirements. PA Systems Hire accepts no liability for failures arising from inaccurate information provided by the Hirer.

4. Hire Charges and Payment

4.1 Hire Charges

All hire charges are as quoted at the time of booking. Quotes are valid for 14 days from the date of issue unless otherwise stated. PA Systems Hire reserves the right to revise charges at any time, but confirmed bookings with a paid deposit will not be subject to price increases.

4.2 Deposit

A non-refundable deposit of 50% of the total hire charge is required to secure the booking. The deposit amount will be stated on your booking confirmation. No equipment will be reserved until the deposit has been received.

4.3 Balance Payment

The remaining balance is due no later than 7 days prior to the Event Date, unless otherwise agreed in writing. For bookings made less than 7 days before the Event Date, the full hire charge is payable at the time of booking.

4.4 Accepted Payment Methods

PA Systems Hire accepts payment by bank transfer, credit/debit card, or such other methods as may be agreed. Cheques are not accepted. All charges are subject to VAT at the prevailing rate where applicable.

4.5 Late Payment

PA Systems Hire reserves the right to withhold or withdraw equipment if payment is not received by the due date. Interest may be charged on overdue amounts at a rate of 8% per annum above the Bank of England base rate.

5. Cancellations and Amendments

5.1 Cancellation by the Hirer

All cancellations must be made in writing to sales@pasystemshire.co.uk. The following cancellation charges apply:

  • More than 28 days before the Event Date: Loss of deposit only.
  • 14–28 days before the Event Date: 50% of the total hire charge.
  • 7–13 days before the Event Date: 75% of the total hire charge.
  • Less than 7 days before the Event Date: 100% of the total hire charge.

5.2 Amendments by the Hirer

Any amendments to a confirmed booking must be requested in writing as soon as possible. PA Systems Hire will endeavour to accommodate changes but cannot guarantee availability of alternative equipment or dates. Additional charges may apply.

5.3 Cancellation by PA Systems Hire

In the unlikely event that PA Systems Hire is required to cancel a confirmed booking due to circumstances beyond its control (including but not limited to equipment failure, force majeure, or staff illness), we will provide as much notice as possible and offer a full refund of all monies paid. PA Systems Hire shall not be liable for any consequential loss arising from such cancellation.

6. Delivery, Collection, and Setup

6.1 Delivery and Collection

PA Systems Hire provides delivery and collection of equipment within London and the South East. Delivery charges are based on location and will be quoted at the time of booking. Collection outside our standard area may incur additional charges.

6.2 Access Requirements

The Hirer must ensure that adequate access is available at the venue for delivery, set-up, and collection of equipment. This includes suitable parking, loading access, and sufficient space for the equipment. PA Systems Hire reserves the right to levy additional charges where access is restricted or where extra time is required beyond what was originally agreed.

6.3 Managed Hire Setup

For Managed Hire packages, PA Systems Hire engineers will arrive at an agreed time to set up and sound-check the equipment. The Hirer is responsible for ensuring the venue is accessible at the agreed time. Any delays caused by the Hirer or venue may result in additional charges.

6.4 Dry Hire Collection

For Dry Hire packages, the Hirer may collect equipment from our premises by prior arrangement. The Hirer must have appropriate transport and is responsible for safely loading, transporting, and unloading the equipment.

7. Use of Equipment

7.1 Permitted Use

The Equipment must be used solely for the purpose stated at the time of booking and in accordance with any instructions provided by PA Systems Hire. The Hirer must not use the Equipment for any unlawful purpose or in any manner that may cause damage or harm.

7.2 Hirer’s Responsibilities

The Hirer is responsible for:

  • Ensuring that all users of the Equipment are competent to do so safely and correctly (Dry Hire only).
  • Ensuring the Equipment is operated within the appropriate technical specifications and volume limits.
  • Complying with all relevant licensing requirements, noise restrictions, and local authority regulations.
  • Securing the Equipment against theft, loss, or damage while it is in their possession.
  • Returning the Equipment in the same condition as it was supplied, fair wear and tear excepted.

7.3 Sub-Hire Prohibited

The Hirer must not sub-hire, loan, sell, or otherwise transfer any of the Equipment to any third party without the prior written consent of PA Systems Hire.

7.4 Noise and Licensing

The Hirer is solely responsible for obtaining any necessary licences, permits, or consents required for the use of amplified sound at the event venue, including but not limited to Temporary Event Notices (TENs) or premises licences. PA Systems Hire accepts no liability for any failure to obtain the required permissions.

8. Damage, Loss, and Liability

8.1 Hirer’s Liability for Damage or Loss

The Hirer is liable for any loss, theft, or damage to the Equipment occurring during the Hire Period, howsoever caused. This includes damage caused by weather, third parties, or misuse. The Hirer will be charged the full replacement or repair cost as determined by PA Systems Hire.

8.2 Damage Deposit

PA Systems Hire may, at its discretion, require a refundable damage deposit prior to release of equipment. This will be returned in full upon the satisfactory return of all Equipment in the condition it was supplied.

8.3 Inspection on Return

All Equipment will be inspected upon return. Any damage or missing items will be documented and notified to the Hirer within 48 hours of collection or return. The cost of repair or replacement will be deducted from the damage deposit or invoiced separately.

8.4 Limitation of Liability

PA Systems Hire’s liability to the Hirer shall in no event exceed the total value of the hire charges paid for the booking in question. PA Systems Hire accepts no liability for any indirect, consequential, or special loss, including loss of revenue, loss of profit, or reputational damage arising from any failure of the Equipment or any act or omission of PA Systems Hire personnel.

8.5 Insurance

PA Systems Hire maintains appropriate public liability insurance in respect of its operations. The Hirer is advised to arrange their own event insurance to cover any risks not covered by the Company’s policy, including damage to hired equipment.

9. Technical Faults and Equipment Failure

PA Systems Hire takes every reasonable step to ensure that all Equipment is in full working order prior to hire. In the event of an Equipment failure arising from a fault present at the time of hire, PA Systems Hire will endeavour to repair or replace the Equipment as quickly as possible. No refund or compensation will be due where equipment failure results from misuse, accidental damage, or circumstances outside our control.

For Managed Hire bookings, our engineers will attend to any technical issues during the event as quickly as possible. For Dry Hire bookings, technical support is available by telephone but the Hirer is responsible for resolving any operational issues on-site.

10. Sound Engineer Services

Where a Managed Hire package includes a PA Systems Hire sound engineer, the engineer will be responsible solely for the set-up, operation, and dismantling of the PA equipment supplied by PA Systems Hire. The engineer is not responsible for:

  • Sound direction from third-party performers, DJs, or artists.
  • Any other technical equipment not supplied by PA Systems Hire.
  • Health and safety matters beyond the immediate operation of the PA system.

The Hirer must ensure that the engineer is provided with appropriate working conditions, including adequate breaks in line with legal requirements. PA Systems Hire reserves the right to withdraw its engineer if they are subject to abusive, threatening, or unsafe conditions.

11. Venue Requirements

The Hirer is responsible for ensuring that the venue meets the following requirements prior to the Event Date:

  • Adequate and appropriate power supply (the engineer or PA Systems Hire representative will advise on requirements at the time of booking).
  • Sufficient space for the equipment as specified by PA Systems Hire.
  • Safe working conditions in line with current health and safety legislation.
  • Compliance with all local authority noise abatement notices and restrictions.

PA Systems Hire reserves the right to refuse to set up or operate the Equipment at any venue that is deemed unsafe or unsuitable. In such cases, no refund of hire charges will be made.

12. Force Majeure

PA Systems Hire shall not be held liable for any failure to fulfil its obligations under these Terms where such failure is caused by circumstances beyond its reasonable control, including but not limited to acts of God, fire, flood, extreme weather conditions, pandemic, civil unrest, government restrictions, power failures, or industrial disputes. In such circumstances, PA Systems Hire will notify the Hirer as soon as practicable and will take all reasonable steps to minimise the impact of the event.

13. Intellectual Property and Music Licensing

PA Systems Hire does not hold or provide any music performance licences. The Hirer is solely responsible for ensuring that all necessary licences are in place for the performance or broadcast of any copyrighted material at the event, including but not limited to PRS for Music and PPL licences. PA Systems Hire accepts no responsibility for any breach of copyright by the Hirer.

14. Data Protection and Privacy

PA Systems Hire is committed to protecting your personal data. Any personal information collected in connection with your hire will be processed in accordance with our Privacy Policy, available on our website at www.pasystemshire.co.uk, and in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Your personal data will be used solely for the purposes of processing your booking, delivering our services, and communicating with you about your hire. We will not sell or share your data with third parties for marketing purposes without your consent.

15. Governing Law and Disputes

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

In the event of a dispute, PA Systems Hire encourages the Hirer to contact us in the first instance to seek an amicable resolution. Complaints should be addressed in writing to sales@pasystemshire.co.uk.

16. Amendments to These Terms

PA Systems Hire reserves the right to amend these Terms and Conditions at any time. The version of the Terms in force at the time of booking will apply to that booking. The most current version of our Terms and Conditions is available on our website at www.pasystemshire.co.uk.
